Terms and Conditions



For the purpose of this agreement, the contractor, cardholder, property owner and property representative are jointly and severally liable and hereby referred to as Customer. 24 Hour Concrete, LLC dba DMV Concrete, and its subsidiaries, affiliates, owners, managers, employees and agents are hereby referred to as Seller.

RELEASE AND INDEMNIFICATION: Seller is not responsible for damage inside curb or property line. In consideration of the delivery of materials to a place designated by customer, customer shall release, indemnify, defend and hold harmless Seller and its agents and employees from all liability and claims for sidewalks, driveways, curbs, roadways, buildings, vegetation and other property from said delivery. Customer assumes all responsibility for damage to all real and personal property.

LIMITED WARRANTY AND WARRANTY DISCLAIMER: Seller warrants for a period of one (1) year from date of delivery only that the material sold hereunder substantially complies with Seller's specifications for said material or the specifications set forth in Seller's quotation. SELLER HEREBY EXCLUDES ALL WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR ANY PURPOSE, AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, OF THE MATERIAL SOLD HEREUNDER, OTHER THAN THE EXPRESS WARRANTY STATED ABOVE. In addition, except to the extent otherwise set forth in the specifications described above, Seller makes no warranty whatsoever with respect to (1) whether any aggregates in said material are innocuous or deleterious, or contain non-reactive aggregates, (2) whether any concrete material is subject to pop-outs, expansion, checking discoloring, spalling, fretting, consolidation, scaling, efflorescence or cracking, (3) the durability of the concrete, including but not limited to sulfate resistance, (4) whether any concrete material, both in its quality, quantity, characteristics, and proportions, including but not limited to cement type and water-to-cement ratio, is in conformance with any plans, other specifications, regulations, ordinances, statutes, or other standards applicable to customer's jobs or to said material as used by customer, or (5) matching of texture and/or color is not guaranteed. No warranty shall apply in the event that water or any other substance or material is added to the concrete either by or at the request of the customer. SELLER SHALL IN NO EVENT BE RESPONSIBLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGE CAUSED BY NON-COMPLIANCE OF THE MATERIAL WITH SPECIFICATIONS, OR ANY DEFECTS IN THE MATERIAL SOLD HEREUNDER.

PAYMENTS: All payments are due prior to delivery. Credit/Debit card payments will be charged prior to delivery. Credit/Debit card information will be stored and charged to satisfy open invoices.

REFUNDS: All sales are final, no refund and/or exchanges. Customer is responsible for any and all chargebacks to include fees as well as any and all collection costs.

FAILURE TO PAY: Failure of the Customer to pay all amounts owed to Seller will be subject to a 10% late fee as well as interest applied monthly at a rate of one and one-half percent (1.5%), if balance is not paid within 30 days.

MATERIAL CHARGES: If purchased materials increase on the job site, the final price may increase from the original invoiced amount. Material prices are subject to change depending on product, quantities and location.

CONDITIONS OF UNLOADING: Driver will deliver concrete to the curb of jobsite address. Concrete can be delivered inside the curb line only if truck is on safe grounds and the customer gives prior authorization and takes full responsibility for any risk or damage to property, concrete vehicle, equipment and personnel. Driver has the right to refuse to unload materials if customer puts truck, equipment or personnel at risk. Seller reserves the right to charge Customer for materials ordered regardless if delivery was made due to setbacks or delays from Customer.

POUR TIME: Customer has the amount of time listed on the Work Order to unload concrete from truck. Amount of time allotted may increase or decrease dependent upon final quantity of materials purchased.

OVERTIME CHARGES: If for any reason Customer takes longer than time given, Customer will be charged for overtime at rates specified by Seller.

DISPOSAL: Customer is responsible for washout of concrete. If Customer does not have a washout location, Customer will be charged an additional fee and is responsible for disposal.

CANCELLATION/RESCHEDULING:
Cancellation/rescheduling must be done 2 hours prior to scheduled delivery time.

PREVENTION:

Obtain special instructions before use, do not handle until all safety precautions have been read and understood.
Do not breathe dust, fume or vapors. Use only outdoors or in a well-ventilated area. Wash hands thoroughly after handling.
Use personal protective equipment as required. Wear protective gloves, protective clothing, eye protection, and face protection.

RESPONSE: If exposed or concerned: Immediately call a Poison Center or doctor/physician. Get medical advice/attention. Get medical advice/attention.

Specific treatment (See the following information on this label)

IF SWOLLOWED: Rinse mouth DO NOT induce vomiting.

IF ON SKIN: Remove/Take off immediately all contaminated clothing. Rinse cautiously with water for several minutes. Rinse skin with water/shower. If skin irritation occurs: Get medical advice/attention.

IF INHALED: Remove victim to fresh air and keep at rest position comfortable for breathing.

IF IN EYES: Rinse cautiously with water for several minutes. Remove contact lenses, if present and easy to do. Continue rinsing. Wash contaminated clothing before reuse.

STORAGE: Store locked up.

DISPOSAL: Dispose of content/container in accordance with all local, regional, national and international regulations.



PRECAUCION

Prevención:: Obtenga instrucciones especiales antes del uso. No maneje hasta que haya leído y entendido todas las precauciones de seguridad. No respire polvo, humo o vapores. Usar únicamente al aire libre o en áreas bien ventiladas. Lávese bien las manos después del manejo. Use equipo de protección personal como requerido. Use guantes de protección, ropa de protección, gafas de seguridad y protección para la cara.

Respuesta:
Si expuestos o preocupados: Contacte inmediatamente un Centro de Envenenamiento o un médico. Consiga consejo/atención médica. Tratamiento específico (ver la siguiente información en la etiqueta)

Caso de indigestión: Enjuáguese la boca, no induzca el vómito.

SI EN PIEL: Quite/Remueva inmediatamente toda la ropa contaminada. Enjuáguese con cautela con agua durante vario minutos. Enjuague la piel con agua/ducha. Si la irritación de piel ocurre, consiga el consejo/ atención médica.

SI SE INHALA: Saca al victima al aire fresco y mantenerla en posición de descanso confortable para respirar.

SI EN OJOS: Enjuague con cautela con agua durante varios minutos. Quite los lentes de contacto, si los hay, y muy fácil de hacer. Continúe enjuagando. Lave la ropa contaminada antes de reutilizar.
Almacenamiento: Almacenar bloqueado.
Eliminación: Deseche el contenido/contenedor de acuerdo con todos los reglamentos locales, regionales, nacionales e internacionales.
